Both Mr. Bravo and Ms. T. W. worked on the same campus under the same supervisory chain and
were bound by the same District policies and PSO procedures. Each faced misconduct
allegations implicating student safety and professional standards. Yet, investigations
diverged sharply. Ms. T. W. remained in her position while Mr. Bravo was subjected to denial
of due process and immediate removal. Ms. T. W.’s case involved 15 staff interviews (31% of
her campus staff) and 172 allegations with 4 witnesses denying the allegations, extensive
documentation (1,719 words), and a rebuttal section (578 words); and the District deemed it
“unsubstantiated.” Mr. Bravo’s case involved 6 student statements (11% of his 2021 class and
7% of his 2022 classes) and 42 allegations with 16 students denying the allegations, no
staff interviews, a 53-word report with 5-word rebuttal section; and it was deemed
“substantiated,” leading to termination proceedings. These contrasting responses by the same
office establish comparability and disparate treatment. Even though one was a teacher and
the other a principal, the relevant comparison lies in the investigative process itself.
